(B) DENIAL OF Rs. 4800 GRADE PAY TO THOSE STATION MASTERS WHO ARE IN Rs.4200 GRADE PAY FOR MORE THAN 20 YEARS
In this regard we wish to present here that the Railway Board’s MACPS instructions under Para 28 (A) (i) & (ii) wherein it is clearly explained that if an employee is continuously working in the same Grade Pay for 20 years, he is eligible for two financial upgradations. But 170 Station Masters of our division have been denied of their 3rd ACP.
The same has been fittingly put into effect in the MACPS orders of PGT, TPJ, TVC and MAS Divisions extending that privilege to their employees, whereas in our Divisional MACPS orders only one financial upgradation has been given.
On enquiry it is learnt that our Personnel Branch is on the wrong notion that an employee is eligible for his 3rd ACP only after his completion of 30 years of service, which is totally wrong. Hence these employees should be accorded with their 3rd ACP.
(C) DENIAL OF Rs.4800 GRADE PAY TO THOSE STATION MASTERS WHO GOT THEIR Rs.4600 GRADE PAY ON REGULAR PROMOTION IGNORING THEIR 20 YEARS OF CONTINUOUS SERVICE IN Rs.4200 GRADE PAY
The position of the 80 Station Masters in Rs.4600 Grade Pay now is the most pathetic one. They are denied of their Rs.4800 Grade Pay claiming that they have not completed 10 years in the present Grade Pay of Rs.4600 or 30 years total service. Whereas the fact is that they have got this present Rs.4600 Grade Pay only after completing more than 20 years in the same Grade Pay of Rs.4200. For example, if somebody got his promotion in 3rd year, his second promotion is deemed to be in 12th year and third should be in 22nd year and the ten years shall not be counted from the actual date of promotion.
This is resulting in a curious case of the latter entrants in service to the Rs.4200 Grade Pay being placed in Rs.4800 Grade Pay whereas the earlier entrants in service who have also completed 20 years in the same Grade Pay of Rs.4200 are still being kept in Rs.4600 Grade Pay denying their claim for Rs.4800 Grade Pay. The above denial of the eligible 3rd ACP to the senior employees is against the provisions found under Para 2.2.11, Para 2.2.13 (i) and Para 6.1.15 of VI CPC Report and are totally in contravention to the above provisions.
As per the above VI CPC report, in Para 2.2.11, it is recommended that in any Pay Band the Grade Pay only will decide the status of a post with Seniors to a Post being given a higher Grade Pay. In Para 2.2.13 (i), it is recommended that Seniority of a Post will depend on the Grade Pay drawn and in Para 6.1.15, it is recommended to avoid uneven financial benefits to employees.
Moreover, the denial of Rs.4800 Grade Pay to senior Station Masters makes the currently existing distinct status quo of the Supervisors and the Supervised getting distorted and this will create confusion in the position of responsibilities. Hence these senior Station Masters should be given Rs.4800 Grade Pay not only on the basis of the VI CPC recommendations but also by virtue of their having continued in the same Grade Pay of Rs.4200 for more than 20 years before getting their present Grade Pay of Rs.4600.
(D) DENIAL OF THE DUE ACP TO THOSE STATION MASTERS WHO JOINED IN OUR DIVISION ON TRANSFER FROM OTHER DIVISIONS/RAILWAYS BY NOT CONSIDERING THEIR EARLIER SERVICE AS STATION MASTERS IN OTHER DIVISIONS/RAILWAYS
The 25 Station Masters who have joined in our Division from other Zones/Divisions of Indian Railways are denied of their 2nd and 3rd ACP treating the 16 Zones and 68 Divisions as separate organizations. The restriction is only on the first promotion and that also when they opt for the lower grade. It is a clear case of refutation of employees’ privileges by the Personnel Branch of Madurai Division misconstruing the Railway Board’s MACPS orders.
While computing the total service of an employee for their pension benefits, the services rendered by that employee irrespective of the Divisions and Railways are being taken into consideration. So there cannot be two different yardsticks for computing the total service for according ACP to such employees.
Hence services in the same cadre elsewhere must be considered for extending the ACP benefits to these Station Masters.
(E) DENIAL OF THE DUE ACP TO THOSE STATION MASTERS WHO BECAME STATION MASTERS FROM OTHER CADRES LIKE CC/TNC/C.MAN BY THE WRONG INCLUSION OF THEIR ABOVE ELEVATION AS A REGULAR PROMOTION
About 7 SMs who have worked in other cadres before becoming Station Masters are also aggrieved a lot in the above issue. In the earlier case, while our Personnel Branch was refusing to consider the service of the same cadre persons stating that they worked in some other Division/Railway, is now claiming that it will include the promotions earned by an employee in some other cadre also for computing the promotions earned. An intriguing interpretation is done solely to deny ACP to such employees because changing from one cadre to the other is only an elevation and not promotion. Whereas promotion is one in which an employee is assigned with a claim/lean when he enters into a cadre and each cadre is having its own declared avenue of promotion. Not only these people were denied of their ACPs but also their fixation of pay was made in a perfidious way making it far below even the new recruits. Such is the crude and perplexing ways of interpretations of Personnel Branch of our Division.
Hence the aforesaid Station Masters should be accorded with their due ACPs as according to their higher benefits feasibility.
The ACP is envisaged to give a relief for an employee who is getting stagnated in a particular cadre and hence their basic entry into the cadre should be the criterion to accord ACP and not their entry into the Railway service through some other cadre since there is a vast difference between both the cadres’ Grade Pays.
The principle aim of ACP is for creating a sense of contentment among the employees who have got stagnated in the same grade without any promotion for years together. Whereas, the same has been totally whitewashed by the misinterpretation of the Personnel Branch of Madurai Division and rather made it as a weapon to victimize few individuals. We strongly feel that the denial of ACP to any employee at this crucial time/fag end of their service, will tantamount to a capital punishment inflicted not only on the employee but also on his entire family which will have a recurring effect on their pension benefits unto death. Even in a DAR action the erring employees are subjected to various stages of disciplinary proceedings and all democratic avenues are also extended to them for making representations to prove their innocence. In the above denial of ACP, the deprived employees are still kept in darkness without passing any speaking orders on the non-consideration of the above benefit.
Hence, we request your Good Office to intervene and direct those Authorities concerned to rectify the absurdities in the implementation of MACPS orders in our Division and do the needful for a Just, Fair and Labour-friendly MACPS orders being released in our Division as being done in our neighbouring Divisions PGT, TPJ, TVC & MAS and safeguard the service interest, working interest, trust and confidence that Station Masters are having over our administrative actions.
